Permissions & copyrightPhotograph Terms of UseA plain-English summary and the full terms.

Summary
This summary is a plain-English guide. It is not the binding text. If it differs from the full terms below, the full terms apply.
All photographs linked from this gallery were taken by me, Thomas Holland, and I own the copyright. Downloading a photograph does not transfer ownership or give you permission beyond what is described here.
If you appear in a photograph, you may, without asking:
- Download and keep it.
- Share it privately.
- Make prints for your own private display or a private personal album.
- Post it on your own personal social media account, provided the account is not used for business, promotion or an organisation, and the post promotes nothing.
Credit is appreciated but not required for these uses.
If other people appear in the photograph, you are responsible for making sure they are happy for you to use it. I cannot do that for you. If you share a photograph privately, please pass these terms on. The person who receives it may keep it, but may not publish it.
Everything else needs my written permission first
That includes CVs, LinkedIn and other professional profiles, portfolios, business or organisational accounts (societies and charities included), websites, newsletters, advertising, press, fundraising, and anything that promotes an event, product, service or cause. What matters is the purpose of the use, not the type of account or whether money changes hands.
To ask, email photography@thomasholland.uk with the photographs you want, who will use them, the purpose, where they will appear (including print) and for how long. Permission only exists once I have approved it in writing. Some permissions are free and some may involve a fee. If I give permission, credit is required.
Whatever the use, these always apply
- Please do not edit the photograph, other than resizing without distortion, routine compression, and any crop the platform or layout needs. Filters, colour changes and retouching need permission.
- No AI manipulation of any kind, and no use of the photographs to train or test AI.
- Do not remove credits, watermarks or copyright information.
- Do not use a photograph to suggest that I or anyone pictured endorses something.
If I ask you to remove a photograph, please do so within 48 hours of my notice. If you would like a photograph of yourself removed from the gallery, email me.
Terms
1. Interpretation and status of the summary
1.1 In these terms:
"Photographer" means Thomas Holland.
"Photographs" means photographs taken by the Photographer and linked from the gallery at thomasholland.uk/galleries.
"User" means any person who downloads, accesses, shares or uses a Photograph.
"Organisation" means any legal person or body, including companies, partnerships, charities, university societies and unincorporated associations.
"Pictured Person" means a User who is a natural person and who appears in the relevant Photograph.
"Personal Account" means a social media account that belongs to a natural person, is not used in whole or in part for business, professional, commercial or organisational purposes, and is not held by or on behalf of any group, society or Organisation. Whether an account is public or restricted is irrelevant.
"Promotion" means promoting, advertising or marketing, or soliciting custom, membership, attendance, sponsorship, support or donations for, any person, business, Organisation, product, service, event, campaign or cause.
"Written Consent" means express approval issued by the Photographer by email from photography@thomasholland.uk, or an agreement in writing signed by the Photographer.
1.2 The summary at the top of this document is provided for guidance only. If there is any conflict between the summary and these terms, these terms prevail.
2. Acceptance and changes
2.1 By downloading, accessing, sharing or otherwise using a Photograph, a User accepts these terms.
2.2 The Photographer may update these terms from time to time. The version published at thomasholland.uk/galleries at the time of a User's use applies to that use. Consent already given in writing continues on the terms of that consent.
3. Ownership
3.1 The Photographer retains sole copyright in the Photographs under the Copyright, Designs and Patents Act 1988 and asserts the right to be identified as their author.
3.2 The Photographs were taken with the permission of the subject or venue, or in circumstances where permission was not required.
3.3 Downloading a Photograph does not transfer ownership or grant any right beyond those expressly stated in these terms or given in Written Consent. All other rights are reserved.
4. Permitted Personal Use
4.1 A Pictured Person may, without Written Consent and without credit, use a Photograph in which they appear for the following purposes:
(a) downloading and keeping it;
(b) sharing it privately;
(c) making prints for private display or a private personal album, without sale or Promotion; and
(d) posting it on a Personal Account, provided the post involves no Promotion.
4.2 Clause 4.1 applies to Photographs in which the Pictured Person appears, and only to that person. It does not extend to friends, family, representatives, agents, employers, societies, businesses or any other person or Organisation, except as set out in clause 4.4.
4.3 A Pictured Person may post a Photograph that includes a group, including a society or team, on a Personal Account where the purpose is personal and the post involves no Promotion. A group, society or Organisational account is not a Personal Account.
4.4 A person who receives a Photograph by private sharing from a Pictured Person may keep it for private personal use but may not publish or otherwise use it, unless they obtain permission under these terms.
4.5 A Pictured Person who shares a Photograph must pass on these terms to each recipient.
4.6 A User who posts a Photograph on a social media platform may grant the platform the limited rights needed to host and display the post under its standard terms. This does not authorise AI training or manipulation, or any licensing to anyone else.
5. Uses requiring Written Consent
5.1 Any use of a Photograph that is not Permitted Personal Use under clause 4 requires Written Consent.
5.2 By way of illustration only, Written Consent is required for use in or on:
(a) CVs, applications, biographies, portfolios, press kits, and professional websites or profiles, including LinkedIn;
(b) business websites and accounts, advertising, sponsored posts, sales listings, promotional emails, flyers and event publicity;
(c) accounts, websites, newsletters, reports, presentations, archives, exhibitions or internal communications of any Organisation, whether commercial or non-commercial, including use by an individual on behalf of an Organisation; and
(d) any Promotion, fundraising, recruitment, sponsorship or merchandise.
5.3 The purpose of a use determines whether Written Consent is required, not the name or type of account, and not whether money changes hands. An unpaid promotional use requires Written Consent, as does use by a charity or non-profit.
5.4 Permission for one purpose does not cover another. Permission for a portfolio or profile does not also cover advertising. An employer, agent or Organisation requires its own permission.
5.5 Selling Photographs, licensing them to others, or using them in merchandise or products for resale requires a separate written licence.
5.6 Written Consent may be given free of charge or subject to a fee, in each case at the Photographer's discretion.
6. Written Consent
6.1 To request Written Consent, email photography@thomasholland.uk identifying the Photographs, the proposed user, the purpose, where they will appear (including in print) and the period of use.
6.2 Making a request, receiving no reply, or giving credit does not amount to consent.
6.3 Written Consent is limited to the specific Photographs, user, purpose, channels and period expressly approved. It is non-transferable and non-sublicensable, and is subject to these terms and any further conditions in the approval. Fresh Written Consent is required for each different or subsequent use.
7. Attribution
7.1 Credit is not required for Permitted Personal Use but is appreciated.
7.2 Credit is a condition of every use made with Written Consent. It must be given as follows:
(a) on Instagram, by tagging @0th.photo in the image or caption; and
(b) everywhere else, including print, as: Photo(s): Thomas Holland (thomasholland.uk).
7.3 Credit must be clear, reasonably prominent and placed beside the Photograph or in its caption. A tag on an account profile alone is not sufficient unless the Written Consent says so. Credit must be retained whenever a Photograph is reposted or shared.
8. Editing, cropping and artificial intelligence
8.1 This clause applies to every User and every use.
8.2 The following are permitted without consent: resizing without distortion, routine compression, and crops that are necessary to fit a permitted layout or platform. Such changes must not remove any credit, copyright notice or watermark, present a person or event out of context, isolate a subject in a misleading way, or materially reduce the quality or alter the meaning of the Photograph.
8.3 All other editing requires Written Consent, including filters, changes to colour or contrast, retouching, combining images, and removing people or objects.
8.4 The following are never permitted: misleading crops or edits; removing, obscuring or altering any visible credit, copyright notice or watermark; and any use of artificial intelligence to alter a Photograph, including enhancement, generative fill, face changes, object removal or background replacement. Written Consent to use or edit a Photograph does not permit these.
8.5 A User must not deliberately remove or change copyright metadata. Automatic changes made by a platform during a permitted upload are acceptable.
8.6 The Photographer may require the removal or replacement of any edit or crop that breaches this clause.
9. Prohibited uses
9.1 No User may, and no Written Consent permits a User to:
(a) use Photographs for political campaigning or to imply political support;
(b) use them unlawfully, to defame any person, or in a misleading, deceptive or harmful context;
(c) state or imply that the Photographer or any person pictured endorses any person, Organisation, product, service, event, campaign or opinion;
(d) use them to train or test artificial intelligence, machine-learning, facial-recognition or biometric systems, or to create synthetic or manipulated media;
(e) upload them to stock libraries, licensing platforms or content-identification systems, or claim ownership of them; or
(f) sell or sublicense them, or use them in advertising, marketing, sponsorship, templates, merchandise or resale products, except under a separate written licence or specific Written Consent.
10. Breach, notice and removal
10.1 The Photographer may withdraw any permission or Written Consent at any time by written notice, unless a separate written agreement says otherwise. Notice may be given by email or by message through the platform on which the Photograph is used.
10.2 The Photographer may give written notice of any breach of these terms or use beyond the scope of any Written Consent.
10.3 Within 48 hours of receiving a notice under clause 10.1 or 10.2, the User must stop all use of the Photograph and remove it from all accounts, publications, platforms and other locations under their control, and must take reasonable steps to ask any recipient or third party to whom they supplied it to remove it.
10.4 Where a use is unlawful, misleading, or reasonably likely to harm the reputation, privacy or safety of the Photographer or any person pictured, the withdrawal takes effect on notice and the User must stop the use immediately, with removal completed within the period in clause 10.3.
11. Third-party consent and indemnity
11.1 A User who posts or otherwise uses a Photograph in which other people appear is solely responsible for obtaining any consent or permission those people require or are entitled to. The Photographer gives no assurance on that point and accepts no responsibility for it.
11.2 A User must indemnify the Photographer against all losses, claims, liabilities, costs and expenses (including reasonable legal fees) arising from the User's breach of these terms or of any Written Consent, or from any claim by a third party relating to the User's use of a Photograph.
12. Deletion requests
12.1 A person who appears in a Photograph may ask the Photographer to remove it from the gallery by email to photography@thomasholland.uk.
13. Separate licences
13.1 Some Photographs may be subject to a separate licensing agreement, including any licence obtained by purchase from another channel operated by the Photographer. Those licences are governed by their own terms. Where a separate written licence or agreement conflicts with these terms, it prevails for the conflicting part and for the relevant Photograph only.
13.2 These terms do not override or affect any such separate arrangement.
14. General
14.1 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
14.2 These terms, together with any Written Consent, form the whole agreement between the Photographer and the User in relation to the Photographs.
14.3 These terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
